Facts
On April 4, 2005, defendant Officer Brian Keaton, a police officer employed by the defendant city of San Diego, pulled over Jacob Faust in relation to an unlawful left turn. Later, defendant Officer Stephen Holliday arrived at the scene. Keaton opened Faust's door and ordered him to step out of the vehicle. Next, Keaton took hold of Faust and stated that Faust, who was unarmed, was trying to reach for an item. At that point in time, Holliday fatally shot Faust. Faust's parents, Richard and Lynn Faust, and his estate sued the city, Keaton, and Holliday.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiffs claimed that the defendants acted negligently.
DEFENDANT'S CONTENTIONS:
The defense contended that the officers observed a handgun located in the back pocket of the passenger seat, which Faust grasped in a hostile manner.
Injuries
The claimed injury was death.
Result
The parties settled.
