Facts

On Feb. 23, 2005, a broken storm drain caused a mudslide in La Jolla that damaged properties located in Caminito Prado, one of which belonged to plaintiffs Kedar and Mary Pyatt.

Defendant city of San Diego authorized up to $650,000 for repairs to the Pyatt's property and other affected properties on May 17. On July 24, 2006, the city authorized up to $980,118 for reconstructions costs and other damages to the affected properties, $874,856 of which was used for repairs and damages.

In June 2007, the Pyatts and other subject property owners agreed to jointly repair their hillside slope that had been compromised by the previous mudslide and soil saturation. The Pyatts agreed to pay 13.74 percent of the cost, and then filed suit against the city for inverse condemnation.

Result

The parties settled.
