Ross and Pamela Pollette sued Peter May Lam and the City and County of San Francisco, in connection with a pedestrian accident that occurred on June 9, 2012.

The City and County of San Francisco was dismissed from the lawsuit prior to trial. The matter proceeded against defendant Peter May Lam only.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that Ross Pollette was crossing Fulton St. within a crosswalk when he was run over by a vehicle driven by defendant. Plaintiffs alleged that Pollette suffered injuries as a result of the collision, and sued defendants for damages. Plaintiffs alleged defendant municipality was also liable for Lam's actions because it negligently designed, monitored, constructed, and maintained the subject intersection. Plaintiffs asserted causes of action for dangerous condition of public property, negligence, and loss of consortium.

DEFENDANTS' CONTENTIONS:
Defendant Lam contested liability, and the extent of residual injuries plaintiff claimed to have sustained.

Result

The jury rendered a defense verdict on liability.
