Justin Neisuler sued the City and County of San Francisco and CWP Sewer, in connection with an incident that occurred on Mar. 2, 2012 near 436 Mangles Ave. in the City and County of San Francisco.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that Neisuler was riding his bicycle along the road in question when the front end of his bicycle came in contact with a crack/depression on the road. Neisuler was thrown off, and sustained injuries as a result. He then sued defendants for negligence, failure to warn, and dangerous condition of public property. His wife, Deborah Neisuler filed a loss of consortium claim.

DEFENDANTS' CONTENTIONS:
Defendants denied plaintiffs' allegations, and asserted various affirmative defenses.

Result

The parties reached a $63,000 settlement.
