Facts

On Jan. 29, 2005, plaintiff Robert Scott, a 76-year-old physician's assistant, was visiting Karly's Winery in Amador County and walking down a short flight of steps with two friends ahead of him. Plaintiff noticed a dog, owned by defendant Robert Kroll, tied to a railing post at the bottom of the stairs. At the last step, plaintiff turned around and backed down the step with his right hand on the railing. Defendant's dog jumped and bit plaintiff's right hand.

Plaintiff was awarded $5,000 in arbitration.

Damages

Plaintiff's counsel suggested a minimum verdict of $25,000; defense counsel suggested a verdict of $2,000-$3,000.
