Facts

On May 26, 2007, plaintiff Robert Citelli was driving his 1983 Honda CS 650T motorcycle southbound on Harbor Boulevard in Ventura. Plaintiff Susan Taylor was a passenger on the motorcycle. Defendant Jerry Goodner made a U-turn from the west curb of Harbor Boulevard in front of plaintiffs Citelli and Taylor. Citelli was driving at a reasonable rate of speed and could not avoid the collision.

The vehicle Goodner was driving, a 2000 Ford Explorer, was owned by defendants Jack Poss and Judith Hall.

Contentions

PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that Goodner operated the vehicle in a negligent, reckless and careless manner and that his U-turn was in violation of Vehicle Code section 22100.5. The plaintiffs further contended that Goodner was the agent of defendants Poss and Hull and, therefore, they were vicariously liable for the acts of Goodner.

DEFENDANTS' CONTENTIONS:
The defendants contended that Citelli was negligent in the operation of his motorcycle and filed a cross-complaint against Citelli on that basis.

Settlement Discussions

The plaintiffs demanded $1,536,008. The defendants met the plaintiffs' demand.

Injuries

Citelli was admitted to Ventura County Medical Center. He suffered right acetabular fracture dislocation, laceration/soft tissue injury to the right knee with exposure to joint, laceration of the left tibia, abrasions to left knee and multiple contusions to the wrists. Taylor suffered segmental right femur fracture, misplaced femoral neck fracture, segmental midshaft fracture and comminuted intra-articular supracondylar femur fracture.

Result

The case settled for $1,536,008.
