On Jan. 29, 2005, in dark and rainy conditions, plaintiff Sylvia Hernandez, a 45-year-old licensed caregiver, was riding as a passenger in a vehicle on Interstate 10, when defendant motorist Howard Rogers sideswiped her vehicle.

Plaintiff claimed neck and back soft-tissue injuries due to the accident.

Defendant contended he lost control and struck plaintiff's vehicle after hitting a puddle.
