Facts

The plaintiff Crystal Fredericks, a 26-year-old restaurant server, sought to recover from defendants under a theory of negligence contending she was struck by a vehicle driven by defendant driver Sharon Jacobson, while allegedly being assisted by defendant employee of defendant Rookies Sports Restaurant and Bar to cross mid-block across El Camino Real, a busy street in Oceanside, and into oncoming traffic.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff alleged all defendants acted negligently.

DEFENDANT'S CONTENTIONS:
The defendant driver alleged that plaintiff darted out into the street without warning into oncoming traffic. Defendants bar and restaurant and its employee contended that the said employee was not present at the time of the accident and so bore no liability for the accident. Defendants also disputed the nature and extent of plaintiff's alleged injuries and damages.
