Facts

On April 17, 2006, Jesse Alvarez, plaintiff, 15 years old, was crossing Valley Boulevard, near Brawley Street in Los Angeles. As he crossed, David Chu, defendant, driving a 2005 Honda, hit him, throwing him into the air. The plaintiff landed about 40 feet away. The plaintiff alleged defendant was negligent. Defendant claimed plaintiff ran into the street in front of his vehicle.

Settlement Discussions

Plaintiff demanded $100,000 prior to mediation. No offers by defendant prior to mediation.

Injuries

The plaintiff suffered facial lacerations, scars, shoulder fracture, head trauma, post-traumatic stress disorder, lower back injury, a 2 mm disc protrusion, headaches and neck pain.

Result

The case settled for $80,000, which included $20,000 in attorney fees, $11,800 in medical expenses, and $5,192 in costs. The plaintiff received $100 and the remaining amount, $43,008 was used to buy an annuity.
