Facts
In February 1988, the plaintiff and defendant entered into a Marital Settlement Agreement that provided for
cooperation and an effort to share expenses of the childrenÆs education post-high school. The plaintiff had
primary custody of the children and the defendant paid child support pursuant to the divorce decree. In May
1988, the plaintiff enrolled the children in private school over the objection of the defendant, who thought that
public school would be better for them. The plaintiff paid the childrenÆs tuition at the private school.
The plaintiff brought this action based on breach of contract and fraud theories of
recovery.
Settlement Discussions
The plaintiff demanded $10,000 at the mandatory settlement conference. The defendant offered $5,000 after the mandatory settlement conference.
Damages
The plaintiff claimed $30,000 in pre-college tuition costs for both children from 1988 until the time of trial, as well as general and punitive damages.
Other Information
The fraud claim was dismissed upon defendantÆs motion for summary adjudication. <A>An arbitration was held before retired judge John Zebrowski from ADR Services.</A>
