Facts
Plaintiff Marcella Navarro was seated in the rear passenger seat of Jared Bryan's vehicle, which was traveling eastbound on Garfield Avenue in Huntington Beach in the number one lane. Kimberly Franz was traveling northbound on SR 39 in the number one lane. The two vehicles collided in the intersection in what resulted in an extremely violent impact. The force of the impact caused Bryan's vehicle to lose control and spin around hitting a tree on the northeast corner of the intersection.
Emergency personnel along with the police department were called to the scene. Upon investigation, Franz advised the officers that she did not know what color the light was at the intersection prior to the impact. Further inquiry by Officer Fulton concluded that Franz was under the influence of drugs and she was arrested for violation of 23155(a) California Vehicle Code.
The plaintiff contended that both drivers had liability for the loss.
The insurance adjusters on behalf of Franz and Bryan eventually accepted liability.
