Facts
On June 17, 2004, Neil Macleod exited off of the St. Vincent Thomas Bridge and was approaching the intersection of N. Seaside Avenue near Navy Way in San Pedro. He had stopped for the red traffic signal when his vehicle was rear-ended by Emilio Guajaca who was driving an international cab tractor with a flat bed trailer. Neil Macleod had no warning of the accident. The defendant never slowed down or attempted to apply his brakes prior to striking Macleod's vehicle.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff contended that defendant Guajaca caused this collision by violating California Vehicle Code Section 22350, unsafe speed for traffic conditions.
DEFENDANTS' CONTENTIONS:
The defendants accepted liability but contested Neil Macleod's injuries and damages as well as Chandra Macleod's claim for loss of consortium.
