Facts

Peter Gala was hired by Anthony Dore and Dore Construction to paint the inside of a property in San Francisco when he fell through the stairwell opening of the second floor. He sued his employers for breach of contract and the owners for premises liability.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff contended no protective barriers of guardrails surrounded the dangerous opening to prevent his fall. Further, the employer defendants never paid the plaintiff his last payment for work performed.

Result

The plaintiff's $89,638 award against Dore was offset by a $47,500 settlement with Millers for a $42,138 judgment plus $5,993 in costs.
