Facts

In June 2005, while inside her rented home, plaintiff Tomica Bedolla claimed she discovered a light shining through a four inch square hole in the lower corner of her dressing room. She alleged that her neighbor, defendant Jorge Aglony, used a surveillance camera to watch her while she undressed. Plaintiff sued defendant for invasion of privacy.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff contended that the defendant utilized night vision and surveillance equipment. Further, when plaintiff called the police, the hole in the exterior wall was mysteriously repaired.

DEFENDANT'S CONTENTIONS:
The defendant contended there were no videotapes seized depicting any illegal surveillance.

Injuries

The plaintiff claimed emotional distress damages.

Result

The jury found for plaintiff and awarded her $275,000, $75,000 of which covered punitive damages.
