Facts

On April 29, 2005, at approximately 7:55 a.m., Maria Carrera, age_____, was lawfully attempting to cross the intersection at Ocean Avenue and Pico Boulevard in Santa Monica.

Defendant city of Santa Monica owned, operated and maintained its Big Blue Bus. Defendant bus driver Consuelo Orantes struck Carrera while the bus attempted to make a right hand turn from Pico Boulevard onto Ocean Avenue, causing Carrera severe injuries leading to her death.

Contentions

PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that the city of Santa Monica negligently maintained and operated traffic signs and signals that were defective at the intersection of Ocean Avenue and Pico Boulevard, making it unsafe for pedestrians to cross in the crosswalk.

Damages

The plaintiffs suffered general damages and incurred burial/funeral expenses.

Injuries

Plaintiffs Oscar Saenz, age ____, Carrera's husband and Eros Saenz, age _____, Carrera's son, have suffered a permanent loss of their wife and mother, and the loss of her love, affection, comfort, society and support, which continues to cause great mental, emotional and nervous pain and suffering.

Result

The case settled for $1.3 million against all defendants.
