Tishbee's LLC and A Plus Fabric Inc. filed an inverse condemnation action against the City of Los Angeles, Los Angeles County Metropolitan Transportation Authority, and Expo Metro Line Construction Authority.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs owned the subject property, which served as a parking lot for their employees, clients, and customers. The subject property was located at the southeast corner of Cameron Lane and South Flower St. in Los Angeles. In 2010, the city authorized the closure of Cameron Lane at the intersection of South Flower St. to stop rail-auto collisions at that location, restricting access to the subject property. The city, Expo and others then proceeded with construction in the area. Plaintiffs contended that the construction effectively cut off their business, causing them to lose business.

Plaintiffs asserted a cause of action for inverse condemnation, seeking just compensation for the taking.

DEFENDANTS' CONTENTIONS:
Defendants denied plaintiffs' allegations, and asserted various affirmative defenses.

Result

Defendants agreed to settle the dispute for $575,000 in exchange for Abutter's Rights.
