Facts

On Oct. 13, 2005, Soybean Chinese Restaurant Inc.'s establishment was inspected buy an independant contractor for insurance coverage. It was determined that the restaurant did not have an automatic shut-off valve for its stove. The restaurant had insurance coverage prior to this inspection.

On Nov. 7, 2006, during temporary coverage, a fire occurred at Soybean Chinese's restaurant's kitchen. An employee who left a rag by the stove caused the fire, which resulted in destruction of part of the kitchen. After this incident, Century issued permanent coverage but denied the loss occurred as a result of the previous fire.

Result

A verdict was reached amounting to $213,400.
