Facts
On Aug. 20, 2004, plaintiff Steven A. Walker, an employee of Pacific Gas & Electric (PG&E), exited the I-280 in his PG&E service vehicle at the Alemany Road off-ramp. Defendant Pedro E. Carias Henriquez was ahead of Walker in his Chevrolet Camaro when Henriquez came to a stop instead of merging into traffic. Behind Walker, defendant Fred Lund was driving a MUNI truck for his employer, defendant city and county of San Francisco. Lund was unable to stop before rear-ending Walker's vehicle; the collision caused Walker's vehicle to hit Henriquez's vehicle.
Contentions
PLAINTIFF'S CONTENTIONS:
Walker contended that Henriquez made an illegal stop and failed to merge into traffic. Walker also claimed that Lund was following Walker too closely given his speed and that he was towing a trailer.
DEFENDANT'S CONTENTIONS:
Lund countered that it was solely the fault of Henriquez; that his failure to merge caused the subsequent damage to all the vehicles and injury to the parties involved.
Injuries
Walker suffered injuries including back pain.
Result
Walker accepted a settlement from SF in the amount of $550,000, and $15,000 policy limits from Henriquez.
