On June 2, 2005, Connor Greene was driving his pickup truck on State Route 18 in foggy weather. As he was making a left turn onto the road, his vehicle and defendant Laura Green's vehicle collided. Greene's vehicle rolled over. Greene brought an action against Green for motor vehicle negligence.
Contentions
PLAINTIFF'S CONTENTIONS:
Greene alleged that defendant was driving over the speed limit at approximately 35-50 mph, which was dangerous due to the fog.
DEFENDANT'S CONTENTIONS:
The defense maintained that Green drove safely at about 25 mph and that in light of Green's experience and the flow of traffic, her speed was appropriate.
Settlement Discussions
Pursuant to C.C.P. section 998, Greene demanded $25,000 and Green offered $7,500.
Damages
The plaintiff requested $260,000 in medical expenses, along with damages for pain and suffering.
Injuries
Greene claimed that he suffered arm, cervical, lumbar, and head injuries. He also sustained abrasions, lacerations and required physical therapy.
Result
The jury decided in favor of the defendant.
