Plaintiff worked as an account manager for defendant, a transportation company. He sued defendant following his termination.

PLAINTIFF'S CONTENTIONS:
Plaintiff, who is black, contended that he was fired because of his race.

DEFENDANT'S CONTENTIONS:
Defendant denied that it fired plaintiff due to his race. Rather, it contended that he was fired for legitimate, non-discriminatory reasons. Specifically, plaintiff was terminated because he retaliated against a subordinate by banning her from the premises after she complained about plaintiff. Plaintiff was terminated because defendant was trying to protect the subordinate.

Settlement Discussions

The defense made a CCP Section 998 offer for $10,000.

Result

The jury returned a defense verdict.
