Facts
The International Longshore and Warehouse Union (ILWU) brought an action against the Port of Portland and several carriers, alleging that under the terms of their collective bargaining agreement the carriers were required to assign all work related to the plugging in, unplugging, and monitoring of refrigerated shipping containers ("reefer work") to the ILWU. When the panel ruled that the carriers could assign work to the International Brotherhood of Electrical Workers (IBEW) rather than ILWU members, the ILWU then brought additional claims for lost work opportunities and refused to withdraw its pending claim under the Labor-Management Relations Act.
The petitioner carriers then brought an unfair labor practices action against the ILWU for refusing to withdraw its pending claim and sought a preliminary injunction precluding the ILWU from filing grievances for lost work opportunities.
Result
Preliminary injunction granted.
