Sandi Seckman was stopped at a stoplight when a vehicle operated by Edmund Moore collided with the vehicle that was stopped immediately behind Seckman's vehicle. The impact caused that person's vehicle to collide with Seckman's vehicle. She was injured as a result of the accident and sued Moore for negligence.
Contentions
DEFENDANT'S CONTENTIONS:
Defendant contended that Plaintiff's knee surgery was unrelated to the accident, and was due to her pre-existing condition. Defendant further contended that there was no trauma to the knee from the accident.
Damages
Seckman's chiropractic care totaled $3,394. She sought $51,479 in medical specials and more than $6,000 in lost wages as well as $7,500 in future medical care. She also sought recover for past and future pain and suffering.
Injuries
The impact caused Seckman's body to be violently thrown about in her vehicle. She presented to her chiropractor four days after the accident with pain in her neck, back, and right knee. Her chiropractor subsequently diagnosed her with various subluxation, a hyperflexion-extension injury, cervical sprain/strain, and knee pain. Seckman further claimed that her knee pain was disruptive and severely limited her physical activities. Although her back recovered, the pain on her neck and knee continued. She later underwent a knee surgery and continued to experience periodic back spasms.
Result
Moore conceded liability for the accident. The jury then found that his negligence was a substantial factor in causing Seckman harm. The jury awarded Seckman nearly $49,000 in damages, which included $25,536 for past medical cost; $3,430 in past lost earnings; and $20,000 in past pain and suffering.
