Facts
Geoffrey Ornstein, a disabled man, was driving and entering an intersection when he was struck by a vehicle operated by John Gardiner. He was injured as a result thereof and sued Gardiner for negligent operation of a motor vehicle.
Injuries
Ornstein went to the emergency room that day, and was discharged. He was later diagnosed with a rotator cuff injury to his left dominant shoulder and underwent physical therapy. Ornstein had a substantial history of orthopedic medical problems that predated the accident, which included an elbow surgery six months prior to the incident.
Result
Gardiner conceded liability. The parties then settled for $25,000.
