Facts
On Sept. 13, 2005, the Lynwood Unified School District transferred Victoria Hammond, an African American woman, from her position as the secretary of Lynwood Middle School. The district placed her in the Special Education Unit in the district office. Hammond sued the school district, and several members of the school board, and administrators for racial discrimination, claiming that the transfer was a demotion without cause.
Contentions
PLAINTIFF'S CONTENTIONS:
Hammond alleged that community member Martino Rodriguez stated that the school board functioned to "get rid of the niggers." Further, the board discriminated against African American employees through harassment, intimidation, removal, and demotion for the purpose of promoting Latinos.
DEFENDANT'S CONTENTIONS:
The defense denied Hammond's claims and contended that its employees acted in good faith and Hammond's transfer did not constitute an adverse employment action.
Injuries
Hammond claimed that she suffered chest pains and emotional distress.
Result
The court found for the defense.
