Facts

As she was walking her dog in La Crescenta, plaintiff Grace Kim, 71, tripped over a concrete water diverter and fell. Kim was transported to Verdugo Hills Hospital by ambulance where she underwent hip replacement surgery. Kim filed suit against defendant County of Los Angeles.

Contentions

PLAINTIFF'S CONTENTIONS:
Kim contended that the diverter constituted a dangerous condition, which the county should have remedied.

DEFENDANT'S CONTENTIONS:
County of Los Angeles countered that Kim failed to use due care while walking in the area.

Injuries

Kim suffered hip injuries requiring replacement surgery and physical therapy.

Result

Kim accepted a settlement in the amount of $72,500.
