PLAINTIFF'S CONTENTIONS:
The plaintiff contended the loose tile on the concourse caused her to fall backward onto her head and back. The mall's records showed the tile was supposed to be repaired but remained loose because the work was never completed. ABM Janitorial Services failed to report the loose tile even though employees must have been aware of the danger from cleaning the area.
DEFENDANT'S CONTENTIONS:
The defendant contended plaintiff fainted, causing her to fall. Defendant had no prior notice that the tile was loose.
