Facts

Thomas Perez, in his capacity as Secretary of Labor, filed a complaint against New Discovery Residential Services Inc. and George Clardy.

Contentions

PLAINTIFF'S CONTENTIONS:
Perez alleged that defendants violated certain provisions of the Fair Labor Standards Act of 1938. Perez alleged that defendants violated the FLSA by paying employees less than $7.25 per hour and failing to pay employees for who worked more than 40 hours in a week at a rate at least one and one-half times their regular wage rate.

Result

The court entered a consent judgment based on an agreement reached by the parties. Pursuant to the consent judgment, defendants were permanently enjoined from violating the provisions of the FLSA. Defendants were also ordered to repay back wages, overtime pay, and interest to certain employees totaling $300,543.
