Elizabeth Stevenson sued Atashi Mandal, in connection with a motor vehicle accident.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that she was stopped at the intersection of Bolsa Chica Rd. and Loyola Ave. in Westminster when she was rear-ended by a vehicle operated by defendant. She was injured as a result, and sued defendant for negligence. Plaintiff alleged that defendant fell asleep on the wheel, causing the collision.

DEFENDANT'S CONTENTIONS:
Defendant disputed the extent of plaintiff's claimed injuries, claiming that her complaints were related to a pre-existing lower back condition.

Injuries

Stevenson claimed she sustained injuries to her neck, shoulders, back, and her hip. She treated with physical therapy.

Result

Mandal settled the dispute for $100,000 at the policy limit on her insurance.
