Joseph Brook filed a medical malpractice suit against Alameda County Medical Center, Highland Hospital-Alameda County Medical Center, William E. Billings Jr., M.D., Afshin Arianjam, M.D., Adam Brooks, M.D., and Matthew Lilley, M.D.

Alameda County Medical Center, Highland Hospital-Alameda County Medical Center, and William E. Billings Jr., M.D. settled with plaintiff prior to trial. The case proceeded to trial against Dr. Arianjam only.

Contentions

PLAINTIFF'S CONTENTIONS:
Brook alleged that one day after he was run over by a truck and suffered a femur fracture he was taken to Highland County Medical Center, where he had surgery performed by Dr. Afshin Arianjam. Brook argued that he was not aware that Dr. Arianjam was a third-year resident and that he never gave informed consent for Dr. Arianjam to perform the surgery. Brook claimed that Dr. Arianjam breached the standard of care by perforating Brook's femoral head intraoperatively resulting in the need for a second surgery.

DEFENDANTS' CONTENTIONS:
Dr. Arianjam denied the allegations of Brook's claim and argued that the standard of care was met.

Injuries

Brook alleged that the surgery performed by Arianjam caused injury to his hip joint, as well as urological injury.

Result

The jury returned a verdict in favor of Dr. Arianjam.

Other Information

Drs. Brooks and Lilley were dismissed before trial in exchange for waiver of costs. FILING DATE: April 4, 2013.
