Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that she owned a 2006 Mercedes-Benz CLS 500 and she and her husband, as well as passengers in her vehicle, received cuts to their hands from chrome trim that was peeling from certain interior parts of the vehicle.
DEFENDANT'S CONTENTIONS:
Mercedes-Benz argued that plaintiff's vehicle did not suffer from a safety-related defect. Mercedes-Benz argued that the alleged injuries underlying plaintiff's claims were superficial and very minor.
Result
The court granted summary judgment in favor of Mercedes-Benz, holding, in part, that the chrome defect was not material because the injuries were not severe enough to be an unreasonable safety hazard.
