Grant Dwyer sued Oganes Muradyan and other defendants, including the City of Los Angeles and Hatami Selinka in connection with a flooded storm drain. The city filed a cross-complaint against Muradyan.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff asserted that a flooded storm drain owned and maintained by the city caused an accident in which plaintiff was injured. Plaintiff alleged he was walking when a vehicle driven by Muradyan jumped a curb and struck him struck him. Plaintiff also alleged that defendant Selinka owned the vehicle driven by defendant Muradyan. Plaintiff further alleged that the city was liable for the accident.
DEFENDANT/CROSS-PLAINTIFF'S CONTENTIONS:
The city asserted claims against Muradyan and Selinka for indemnification, apportionment of fault, and declaratory relief.
Result
The city agreed to pay a $465,000 settlement.
