Los Angeles Waterkeeper brought an action against Bestway Recycling Co. Inc. and Los Angeles Recycling Center Inc.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that defendants violated the Storm Water Permit and the Clean Water Act in the operation of certain recycling facilities. Plaintiff alleged that polluted rainwater from defendants' facilities discharged into Los Angeles area waters.
DEFENDANT'S CONTENTIONS:
Defendants' denied the allegations of plaintiff's claims.
Result
A consent decree was entered based on the agreement of the parties. Under the consent decree, Bestway agreed to develop and implement "Best Management Practices" in order to comply with "Best Available Technology Economically Achievable" and "Best Conventional Pollutant Control Technology" standards and to comply with relevant Water Quality Standards. Defendants further agreed to pay a total of $260,000 towards compliance monitoring, for a certain environmental project, and to partially reimburse plaintiff's fees and costs in connection with the suit.
