Facts

Deepak Grover filed an action against Megan Baker, Derek Baker, Timothy Putnam and Sunshine Makers Inc. in relation to a motor vehicle incident.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on Feb. 5, 2011, his car broke down at an intersection, so he exited his car. While he was outside of the car, Megan Baker and Putnam were involved in an accident nearby. Baker's car then hit plaintiff, causing him injuries. He argued that the drivers were negligent and that Megan's father, Derek, should be liable as the owner of her car, and that Sunshine, Putnam's employer, should be labile as well.

DEFENDANT'S CONTENTIONS:
Putnam argued that Baker was at fault for the accident, whereas Baker argued that Putnam drove too fast to make a green light, and caused the car to hit plaintiff. The defendants also claimed that plaintiff should not have been standing outside of his car in the middle of the street. Defendants argued that plaintiff only broke toes due to the accident, in contrast to his claimed injuries.

Damages

Plaintiff asked for $24,000 in past medicals, $75,000 in future medicals, $53,000 in past lost wages, and $490,00 for future lost wages.

Injuries

Grover suffered fractures to his ankle, metatarsal, tibial plateau and toe. He received physical therapy.

Result

The jury awarded plaintiff $156,740, concluding that Putnam and Sunshine were 85 percent liable and Grover was 15 percent liable. It found Baker and her father were not liable. Due to a comparative liability offset, plaintiff received $133,229.
