Deidrenne Ashcraft filed a lawsuit against Event Magic Inc., and Private Bar Lounge Inc. doing business as Roe Restaurant in relation to injuries she allegedly suffered.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff claimed she was at a nightclub on June 18, 2011, that held live performances. Plaintiff alleged a light stand situated in the club fell over and struck her in the head. She argued that defendants did not keep the area safe, and caused a dangerous condition because they did not weigh down the light tree with sand bags or other items, making the tree unstable.

DEFENDANT'S CONTENTIONS:
Defendants argued that plaintiff was unaware as to what actually struck her, and that they did keep a secure establishment. Defendants contended there were no witnesses to the alleged incident.

Defendants argued that plaintiff's companions said the incident occurred on the upper floor, while plaintiff said it occurred on the main floor, and that plaintiff was not credible. Defendants also argued plaintiff overstated her injuries and her claims of inability to work.

Damages

Plaintiff asked for $68,000 in past medical expenses, $323,686 in past lost wages, and $2,068,548 in future lost wages.

Injuries

Ashcraft claimed she suffered a concussion, contusion, post-concussion syndrome, a shoulder injury and vestibular deficitis. She required physical therapy. Plaintiff also claimed psychiatric injuries.

Result

Under a settlement, plaintiff received $702,000. Event Magic contributed $500,000 while Private Bar contributed $202,000.
