Alberto Pulido filed a lawsuit against the City of El Segundo, the El Segundo Police Dept., Jack Wayt, Officer Leyman, David Reaver, and Adelhorst International Inc. The city, Wayt, and Leyman filed for summary judgment on the issue of their liability, which the trial court granted. Reaver and Adelhorst remained.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on July 8, 2012, he was at a warehouse in El Segundo, looking for a parolee as part of his work as a parole officer, and officer Leyman and his K9 were called to the scene as well. While there, plaintiff alleged that the K9 bit him. He argued that the city, its police department, its officials and Leyman were liable because Leyman failed to properly handle the dog and the city and its officials were vicariously liable. Also, he argued that the training academy the dog was placed in, Adelhorst, should be held liable for failing to properly train the dog.

DEFENDANT'S CONTENTIONS:
Defendants argued that plaintiff received warnings to depart the area where the search was taking place, but did not do so, despite three admonitions. In addition, if plaintiff had remained still, instead of raising his arm, the attack would not have happened.

Damages

Plaintiff asked for $30,000 for his pain and suffering.

Injuries

Pulido claimed he suffered a bite mark and resulting puncture wound.

Result

The jury's verdict favored the defense.
