Beats Electronics LLC filed a lawsuit against Marcus Finkley.
Contentions
PLAINTIFF'S CONTENTIONS:
Beats alleged that it sells well-known sound transmission products, including headphones, earphones, and speakers and also held various trademarks in connection with its products. Beats further alleged that Finkley marketed and sold various counterfeit Beats products through the eBay website.
DEFENDANT'S CONTENTIONS:
Defendants denied the allegations plaintiffs' complaint.
Result
Upon stipulation of the parties, the court entered a permanent injunction against Finkley. Finkley was enjoined from using any of using Beat's trademarks and prohibited from selling or marketing any products that used Beat's trademarks or were similar to Beat's trademarks. Finkley was further ordered to deliver for destruction all unauthorized or counterfeit products relating to Beat's trademarks that were in his possession. Finkley also agreed to make certain payments to Beats, pursuant to a separate settlement agreement.
