Facts
WirelessComm distributed for Metro PCS, a cell phone provider. Deisy Mora was a manager at a WirelessComm store. The Equal Employment Opportunity Commission (EEOC) filed a lawsuit on her behalf against the employer, alleging sexual harassment under Title VII of the Civil Rights Act of 1964. Deisy Mora intervened in the lawsuit and filed a Complaint in Intervention against WirelessComm, Lahouri Aribi (owner) and Karim Hadid (manager) under Title VII and the California Fair Employment and Housing Act.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that when Mora was 19-years-old, her supervisor made offensive sexual comments to her, and sent her unsolicited texts and photographs. In addition, Mora claimed that the company did not address her complaints, which caused her to quit her job.
Result
The parties reached an agreement according to which WirelessComm will pay $97,000, hire an equal opportunity consultant and a human resources consultant, change its policies, train management, monitor the workplace, respond to harassment allegations, and report harassment to the EEOC.
