On Jan. 17, 2011, at 7:55 a.m., plaintiff Alexander Mikhail, 27, was riding his 2003 Kawasaki Ninja X6RR, southbound in the number 1 lane of Harvard as he approached the intersection with Alton in the City of Irvine. Plaintiff enjoyed a green traffic signal. Suddenly and without warning, a red 2005 Honda Element driven by Winston Yang and owned by Cha Yang, traveled through the red traffic signal westbound on Alton causing a traumatic collision. As a result of the impact, Plaintiff was thrown from his motorcycle and suffered serious injuries.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs contended Winston Yang ran a red traffic signal. Independent witnesses and the investigating police officer confirmed this.
DEFENDANT'S CONTENTIONS:
Winston Yang argued that his traffic signal was green.
