Facts

National integrity Life Insurance Co. sued Countrywide Financial Corp., its corporate affiliates, and various officers and directors, including Mozilo, alleging violation of the Exchange Act, Ohio blue sky law, Ohio RICO laws, and common law fraud and civil conspiracy. The claims related to National Integrity's purchase of $94 million in Countrywide mortgage-backed securities between 2005 and 2008.

Result

The Court ruled in favor of Mozilo and the other defendants' motion to dismiss the Exchange Act, Ohio blue sky law, Ohio RICO law, and civil conspiracy claims with prejudice based on statute of limitations ground and failure to state a claim. National Integrity's common law fraud claims against Countrywide were allowed to continue.
