Guardsmark LLC sued Derrick Bowman, William Bodin, and Teton Security Services Inc.. in connection with the parties' competing businesses providing security services to the City and County of San Francisco.
Contentions
PLAINTIFF'S CONTENTIONS:
Guardsmark claimed that Bowman worked as a manager for Guardsmark before leaving the company to form his own rival company, Teton Security. Guardsmark claimed that it bid on a contract with the City of San Francisco, and that Teton Security had also bid and later won this contract due to Bowman's misappropriation of trade secrets. Guardsmark asserted claims for breach of duty of loyalty; breach of contract; breach of fiduciary duty; tortious interference with prospective economic advantage, misappropriation of trade secrets, and unfair competition. Additionally, Guardsmark moved for a restraining order against defendants.
Result
The parties agreed to settle the dispute, which provided for an injunction enjoining defendants from competing with Guardsmark business for a period of 12 months.
