Relatives of Shirley Finkelstein, 78, brought a wrongful death action against defendants after she died on Feb. 6, 2014 while a patient at Long Beach Memorial Medical Center.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that defendants were negligent in the medical care and treatment of Finkelstein. Specifically, they claimed that Finkelstein had an esophageal perforation and rupture that was not diagnosed in a timely manner. The negligent delay in diagnosis was a substantial factor in causing her death.
DEFENDANTS' CONTENTIONS:
Long Beach Memorial Medical Center contended it was entitled to summary judgment because plaintiffs were not able to establish the elements of breach of care or causation.
Result
The court granted the hospital's motion.
