Olympian Oksana Baiul sued defendants relating to her 1994 television performance in "Nutcracker on Ice Starring Oksana Baiul."
Contentions
PLAINTIFF'S CONTENTIONS:
Baiul contended that due to fraud or mistake she never entered into a performance agreement with defendants, and that defendants failed to pay her royalties for her performance. Plaintiff claimed defendants converted, and were unjustly enriched by her headline performance. She brought claims for unjust enrichment based on fraud or mistake, conversion and restitution, and accounting.
DEFENDANTS' CONTENTIONS:
Defendants contended they were entitled to dismissal because Baiul failed to state a claim for conversion, unjust enrichment or accounting, and because her causes of action were barred by the statute of limitations.
Damages
Baiul sought $10 million in damages.
Result
The court granted NBC Sports' motion to dismiss.
