Facts
On June 15, 1998, plaintiffs Estensor Cosios, Maria Cosios, Jersey Cosios, Queen Cosios, Alex Cosios, Diana Cosios, and Lucy Cosios rented property on 1054 W. Gage Ave. in Los Angeles. While they lived there, plaintiffs were exposed to toxic mold, lead, and other airborne contaminants. On July 11, 2003, the Dept. of Health Services issued a report indicating samples from the residence contained hazardous levels of lead.
The plaintiffs sued defendant Cruz, alleging violation of the Los Angeles rent stabilization ordinance, nuisance, breach of warranty of habitability, negligence, constructive eviction, intentional and negligent infliction of emotional distress, and unfair business practices.
Injuries
The plaintiffs suffered lead poisoning; mold-related injures; and emotional distress.
Result
Minor plaintiffs settled the case for $100,000, which included $12,297 in attorney fees and $12,850 costs. Plaintiff Lucy Cosios received $52,000 less $162 medical lien; $12,297 attorney fees; $2,649 costs. Plaintiff Diana Cosios received $12,000 less $10 medical lien; $2,357 attorney fees; $2,562 costs. Plaintiff Jersey Cosios received $12,000 less $163 medical lien; $2,349 attorney fees; $2,442 costs. Plaintiff Alex Cosios received $12,000 less $143 medical lien; $2,309 attorney fees; $2,623 costs. Plaintiff Queen Cosios received $12,000 less $51 medical lien; $2,361 attorney fees; $2,507 costs.
