Facts

Plaintiff Cynthia Woo was pregnant with twins. In July 2004, she developed placental separation and bleeding. She was taken to defendant Los Angeles County and USC Medical Center, where she was seen by defendants Alan Israni, M.D., Smeeta Sardesai, M.D., and Karmen Parks, M.D. Plaintiff and her family members, Wilson and Brandon Woo, claimed defendants negligently taped equipment to plaintiff Brandon's face. The procedure caused pressure necrosis and wounds to the area above the infant's lip. As a result, plaintiff Brandon suffered from extensive raised hypertrophic scarring.

The plaintiffs claimed medical malpractice, alleging defendants were negligent and caused the injury.

Contentions

DEFENDANTS' CONTENTIONS:
The defendants contended that plaintiff experienced an allergic reaction to the oxygen apparatus, which had resolved by the time he was discharged.

Damages

The plaintiffs claimed damages for the injury and negligent infliction of emotional distress.

Injuries

The plaintiff sustained a scar to his upper lip, an obstructed nostril, necrosis of the skin, speech problems, and disfigurement. He also suffered from post-traumatic stress disorder.

Result

The case settled for $385,000.
