PLAINTIFF'S CONTENTIONS:
The plaintiff claimed that he was a non-exempt employee and should have been paid overtime and missed meal period wages. While he performed management duties some of the time, he did not engage in exempt activities more than 51 percent of his work hours as is required to be exempt under California law.
DEFENDANTS' CONTENTIONS:
The defendants contended that plaintiff engaged in exempt activities more than 51 percent of the time, and was expected to do so, thereby validating the exemption from payment of overtime and meal period wages.
Result
$293,999.55 plus fees and costs. The judge found for plaintiff on both the overtime and meal period wage claims.
