Facts

On March 15, 2005, plaintiff Chen Zhang, a 61-year-old retiree, was crossing the street after dropping off her grandson at school when she was run over twice in the crosswalk of Sunset Boulevard and Noriega Street, where she had a green light.

Defendant Anchie Kuo was driving a SUV hit her, running her over. Defendant John Wei, driving a pick-up truck behind Kuo also ran over plaintiff, dragging her approximately 100 feet. Both defendants claimed to had not seen plaintiff. Defendant Wei claimed he would not have hit plaintiff if she had not already been knocked to the ground by defendant Kuo.

Damages

Plaintiff sought $350,000 for loss of household services and a life care plan. Plaintiff's husband sought damages for loss of consortium.

Injuries

Mild traumatic brain injury; laceration to her chin; abrasions. Defense counsel disputed the nature and extent of plaintiff's injuries.

Result

With the help of a mediator, the parties settled for $1,125,000 before trial. Kuo's insurer, Encompass Insurance paid $1,075,000 and Wei's insurer, Farmer's Insurance Co. paid his policy limit of $50,000.
