Facts

On Feb. 15, 2010, a vehicle operated by Kevin Arias crashed into the back end of a vehicle operated by Alma Martinez on Route 101. She sued Arias for negligent operation of motor vehicle.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that just prior to the accident, traffic decreased in speed on the freeway, but Arias did not stop his car such that he could avoid hitting Plaintiff's car.

Settlement Discussions

CCP 998 offer was $25,000.

Damages

$14,124 special damages at the time complaint was filed. Statement of damages was $72,500.

Injuries

Plaintiff suffered back and neck injury soft-tissue injury, radiculopathy, and strains and sprains. She required chiropractic treatment.

Result

The parties settled for $25,000.
