John Waters filed suit against Carolyn Colvin, the Acting Commission of Social Security, seeking review of a decision denying his application for disability insurance benefits.
Contentions
PLAINTIFF'S CONTENTIONS:
Waters applied for disability in 2009, alleging he had been disabled since Oct. 16, 2009, due to seizures that would cause him to "zone out" or lose focus. Because his job involved operating vehicles, having uncontrolled and unexpected seizures made him unfit to continue working.
Result
The court reversed the administrative determination, and ruled in favor of Waters.
