Facts

St. Jude Medical filed a patent infringement lawsuit against Access Closure Inc. in relation to vascular closure devices, which are used to close holes in arteries in the course of cardiac procedures. Concluding that the infringement was willful, a jury awarded plaintiff $27.1 million. A follow-on bench trial occurred to address whether a St. Jude patent was protected from Access's claims of invalidity due to double patenting.

Result

The court ruled that a Safe Harbor provision in the Patent Act applied and that the patent was not invalid.
