Monica Mojica was riding in a vehicle operated by her husband, Hector Gonzalez, on Oct. 13, 2006, traveling on Fremont Avenue in Alhambra, when the vehicle was broadsided by a vehicle operated by Seling Szeto.
Contentions
PLAINTIFF'S CONTENTIONS:
Mojica filed suit against Szeto and the vehicle's owner, Annie Choy, alleging motor vehicle negligence and vicarious liability. Mojica contended that Gonzalez was waiting in the intersection before starting to make a left turn when Szeto sped through a red light in the intersection and struck their vehicle on the front passenger side.
DEFENDANT'S CONTENTIONS:
Szeto contended she drove through a yellow light and that Gonzalez was negligent in failing to wait for oncoming traffic to clear before turning.
Damages
Mojica sought $60,000 in past medical costs, and total damages of $100,000 including pain and suffering.
Injuries
Mojica sustained a lumbar disc bulge, undergoing physical therapy and chiropractic treatment.
Result
The jury found Szeto 70 percent liable, and awarded Mojica $35,000 in damages, offset by fault.
